(4.101) For the purposes of subsection (4.1), property means (4.1) Everyone who commits mischief in relation to property described in any of paragraphs (4.101)(a) to (d), if the commission of the mischief is motivated by bias, prejudice or hate based on colour, race, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression or mental or physical disability, Marginal note:Mischief relating to religious property, educational institutions, etc. (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years or (4) Every one who commits mischief in relation to property, other than property described in subsection (3), (b) is guilty of an offence punishable on summary conviction.
